1. Agreement to Terms

By accessing or using StarsBots (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

2. Use License

Permission is granted to access and use the Service for personal or commercial chatbot automation purposes. This is the grant of a license, not a transfer of title. Under this license you may not:

  • Modify, copy, or create derivative works of the Service
  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to decompile, reverse engineer, or extract source code from the Service
  • Remove any copyright, trademark, or proprietary notices
  • Transfer your license or account to another person without written permission

3. User Accounts

When you create an account, you must provide accurate, complete, and current information. You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information remains accurate and up-to-date

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Acceptable Use

You agree not to use the Service:

  • In any way that violates applicable local, national, or international law or regulation
  • To send spam, unsolicited messages, or violate anti-spam laws (including CAN-SPAM, GDPR, and applicable messaging platform policies)
  • To impersonate any person or entity or misrepresent your affiliation with any person or entity
  • To transmit any content that is unlawful, harmful, defamatory, or infringing
  • To interfere with or disrupt the integrity or performance of the Service
  • To attempt to gain unauthorized access to any part of the Service or related systems

5. Subscription and Payment

5.1 Subscription Plans

We offer various subscription plans with different features and pricing. By subscribing to a plan, you agree to pay the applicable fees as described on our pricing page.

5.2 Billing

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

5.3 Auto-Renewal

Your subscription automatically renews at the end of each billing period unless cancelled before the renewal date. You may cancel at any time through your account settings.

6. Intellectual Property

The Service and its original content, features, and functionality are the exclusive property of StarsBots and its licensors, protected by copyright, trademark, and other laws.

You retain ownership of content you submit through the Service but grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content solely to provide the Service to you.

7. Service Availability

We strive to provide reliable and continuous access to the Service but do not guarantee that the Service will be available at all times, error-free, or meet your specific requirements. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

8. Limitation of Liability

To the maximum extent permitted by law, StarsBots shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including any loss of profits, revenues, data, or goodwill, arising from:

  • Your use or inability to use the Service
  • Any conduct or content of third parties on or through the Service
  • Unauthorized access to or use of our servers or your data
  • Interruption or cessation of Service transmissions
  • Actions, decisions, or policies of third-party platforms including Meta Platforms, Inc., Twilio, or other integrated providers
  • Changes to or deprecation of Meta platform APIs, permissions, or policies that affect chatbot functionality

9. Indemnification

You agree to defend, indemnify, and hold harmless StarsBots and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights or third-party platform policies (including Meta Platform Terms).

10. Termination

We may terminate or suspend your account without prior notice or liability for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately. All provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days’ notice for material changes. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which StarsBots operates, without regard to conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Third-Party Platform Integrations

13.1 Nature of Third-Party Integrations

StarsBots enables integration with third-party messaging platforms including WhatsApp Business (Meta Platforms, Inc.), Instagram Direct (Meta Platforms, Inc.), Facebook Messenger (Meta Platforms, Inc.), and SMS via Twilio. By connecting these channels, you acknowledge and agree that:

  • Your use of connected third-party platforms is separately subject to those platforms’ own terms of service and privacy policies
  • We act as a technology intermediary and are not responsible for the availability, reliability, or policy decisions of third-party platforms
  • Third-party platforms may modify, restrict, or revoke API access at any time, which may impact chatbot functionality without notice
  • You are solely responsible for ensuring your use of third-party platforms complies with their respective terms and policies

13.2 Your Responsibilities as a Channel Operator

When you connect Meta channels (WhatsApp, Instagram, or Messenger) or other third-party platforms, you represent and warrant that:

  • You are the authorized owner or administrator of the connected Facebook Page, WhatsApp Business Account, or Instagram Business Account
  • You have obtained all necessary consents from end-users to receive automated messages and have your conversations processed by AI
  • Your chatbot content complies with all applicable laws and the platform’s messaging policies, including WhatsApp Business Policy, Instagram Platform Policy, and Facebook Platform Terms
  • You will not use connected channels to send spam, illegal content, or messages that violate Meta’s prohibited content policies
  • You are responsible for the content, accuracy, and legality of all messages sent through your chatbots
  • You will promptly inform end-users when they are interacting with an automated chatbot system

13.3 Data Handling Through Third-Party Platforms

When your chatbot processes messages through Meta channels:

  • Message data passes through Meta’s infrastructure before reaching our servers via webhook
  • We store message content and sender identifiers to provide conversation history and enable AI-powered replies
  • You, as the chatbot operator, are the data controller for end-user conversations processed through your account
  • We process end-user data as a data processor acting on your instructions
  • You are responsible for providing adequate privacy notices to your end-users about chatbot data processing

13.4 Limitation of Liability for Meta Platform Actions

We shall not be liable for any service disruptions, loss of access, policy enforcement actions, or account suspensions imposed by Meta Platforms, Inc. or any other third-party platform in connection with your use of their platforms through our Service. You acknowledge that our ability to provide Meta-integrated features depends entirely on Meta’s continued API availability and is subject to change.

14. Meta Platform Terms Compliance

14.1 Platform Policy Adherence

Our Service is built on Meta’s official APIs and operates in compliance with the Meta Platform Terms, Meta Platform Developer Policies, WhatsApp Business Policy, and all applicable Meta usage policies. By using Meta-integrated features of our Service, you agree to comply with these same policies.

14.2 Prohibited Meta Platform Uses

When using Meta platform integrations through our Service, you specifically agree not to:

  • Use automated messaging to harass, threaten, or spam users
  • Send promotional messages to users who have not opted in through Meta-approved opt-in flows
  • Collect or harvest user data beyond what is necessary for your stated chatbot purpose
  • Impersonate Meta, Facebook, WhatsApp, or Instagram in any automated messages
  • Use the integration to process payments or financial transactions in violation of applicable regulations
  • Create chatbots targeting minors without parental consent mechanisms
  • Circumvent Meta’s review processes, rate limits, or security measures

14.3 Operator Responsibility for Compliance

You are solely responsible for ensuring that your chatbot’s use of Meta platforms passes Meta’s app review process (where required) and remains in compliance with Meta’s policies at all times. Violations of Meta Platform Terms by you may result in revocation of your API access, disconnection of your channels from our Service, and/or suspension of your account.

14.4 No Endorsement by Meta

StarsBots is an independent service and is not affiliated with, endorsed by, sponsored by, or in any way officially connected with Meta Platforms, Inc., Facebook, WhatsApp, or Instagram. The Meta, Facebook, WhatsApp, and Instagram names and logos are trademarks of Meta Platforms, Inc.
